An application for annulment on grounds of procedural flaws—either substantial or prescribed under penalty of nullity—as well as abuse or misuse of power, may be brought before the Council of State against any decision made by the Jury. This can be done by any party demonstrating harm or a vested interest, within sixty days from the notification of said decision, in accordance with Article 4, §1, paragraph 3 of the Rules of Procedure established by the Regent’s Decree of 23 August 1948. This appeal, signed by the party concerned or by a lawyer, must meet specific requirements in terms of form and content.

If the individual considers the matter too urgent to be addressed within the framework of an annulment appeal, a suspension appeal may be introduced at any time—either immediately with the annulment request, or through a separate later request—according to Article 17, §1, paragraph 2 of the coordinated laws on the Council of State of 12 January 1973. This appeal must also meet specific requirements in form and content. In particularly urgent and exceptional cases, a request for extremely urgent suspension may be submitted to the Council of State.
